What Whim is
Whim is a marketplace where independent creators sell apps and games they've made. Whim is the platform, not the maker of the apps: sellers own their apps, set their prices, and are responsible for having the rights to everything they upload and sell. When you buy an app, you're buying from its creator, with Whim handling the storefront and delivery.
You keep your app
You own your app and everything in it. Listing it on Whim transfers no ownership and no intellectual property to us. All you grant is a limited license to host your app and deliver it to the people who play or buy it, for as long as you keep it listed. We do not resell your work, we do not claim it as our own, and you can unlist it and leave at any time.
Your license as a buyer
Buying an app gets you a personal-use license: play it in your browser, and (when the seller allows) download a copy to keep for yourself. It doesn't transfer ownership of the app, and it doesn't include the right to resell, redistribute, or republish the app or its code.
Payments and fees
Payments are processed by Stripe. Whim keeps a 10% platform fee on each sale; sellers keep the rest. Publishing a listing costs a one-time $0.99 fee — every seller's first listing is free. Optional tips to creators are split the same way as sales (Whim keeps 10%, with Stripe's processing fees coming out of Whim's cut); a tip is a voluntary payment and doesn't grant a license or library access. Featured placement and other optional promotions are charged separately at the prices shown when you buy them.
Refunds are handled case-by-case: if something you bought doesn't work as advertised, contact hello@buywhim.com and we'll sort it out.
What you can't sell
Listings must not include:
- Content you don't have the rights to (stolen or infringing work)
- Malware, or anything designed to harm users or their devices
- Illegal content or content that facilitates illegal activity
- Hateful or harassing content
Moderation
We may remove listings, refuse uploads, or suspend accounts that break these terms or put users at risk — including in response to user reports and takedown requests. Sellers whose content is removed for infringement or abuse aren't owed a refund of listing or promotion fees.
Achievements and launch programs
Perks like achievements and the founding-creators program (e.g. waived listing fees) are goodwill programs, not contractual guarantees — their terms may evolve as Whim grows. We'll aim to honor perks already granted.
No warranties; limitation of liability
Whim and the apps sold on it are provided "as is", without warranties of any kind. Apps are made by independent creators; we sandbox browser apps but don't audit every line of code. To the maximum extent allowed by law, Whim's liability for any claim related to the platform is limited to the amount you paid Whim in the twelve months before the claim.
Changes to these terms
We may update these terms as the platform evolves. Material changes will be reflected on this page with a new "last updated" date; continuing to use Whim after a change means you accept the updated terms.
